Platform for Human Rights Files Injunction for the Health of Oaxaca

The 18 organizations that make up the Platform for Human Rights (Plataforma de Derechos Humanos) have seen a crisis in the health system, denounced in the Early Warning of the Ombudsman’s Office, since the end of last year. As part of a collective work, the Platform has filed an injunction for the failure to guarantee the right to health in the state of Oaxaca and its regions, which is in the process of being admissible.

It is important to remember that the right to health is guaranteed in Article 4 of the Political Constitution of the United Mexican States, in Article 25 of the Universal Declaration of Human Rights, in Article 12 of the International Covenant of Economic, Social, and Cultural Rights, as well as in the General Law of Health, where it stipulates that every person has the right to the protection of health.

With deep concern, through various press releases as well as statements that have been made public through social networks, we have observed and documented the failure of federal and state authorities to guarantee the right to health by providing sufficient supplies of medicines, medical personnel, and infrastructure for the prevention, diagnosis, treatment, rehabilitation, and care of diseases and/or conditions. In addition, the suspension of surgical interventions in the General Hospital “Dr. Aurelio Valdivieso,” among other problems, has left a big part of the population without services.

All of the aforementioned problems violate the right to the highest enjoyment of health and compromise personal integrity, especially of women, children, teenagers, and those in vulnerable situations. Because of this, the organizations that form part of the Platform of Human Rights have gone to the federal courts to demand the protection of the right to health as a collective right. We are urgently calling on authorities in healthcare to guarantee the right to health for the Oaxacan population. To do this, we should not need an injunction, only the willingness of the different levels of government to coordinate actions that allow us to correct the shortcomings that we have seen in recent months.
